Flying a drone: how much fun is that!
You are used to us that we often use drone images in our videos.
What about the rules actually? Can you just fly with a drone?
And what about abroad?
I have previously mentioned in a video that there would be new rules for all of Europe.
The time has now come: on December 31, 2020, the new EU drone rules have come into effect.
Every drone pilot (driver) now has to deal with those rules.
I'm going to explain to you what the new rules mean, but I'll do that in the studio.
First I will fly a bit because the weather is beautiful.

So, I am back inside and it is nice and cozy and warm here.
So I am going to tell you what the new European drone regulations entail and what that
means for flying a drone. The new rules took effect on December 31, 2020, so every
drone pilot will have to deal with it from now on. Let me start with good news. The
new rules no longer make a distinction between hobby pilots and professional
drone pilots. Instead, three categories have been created, namely
the Open, the Specific and the Certified Category. The starting point here is no longer who is flying,
but of the risk that a flight poses. Most of the recreational
drone pilots, like us, will end up in the Open category. This is again
divided into three risk subcategories: A1, A2 and A3. Anyone who wants to fly outside the limitations of these
subcategories will automatically end up in the Specific category or even the
Certified category. But we will leave that out in this video because it is really for
the heavier drones and professional pilots. Important: From January 1, 2023, all
new drones that you buy ready-made will receive a CE label. This label helps you to determine which
category you will end up in and which exam (or exams) you should take. Note:
none of the drones that are currently being sold have such a CE label yet. A
transitional arrangement of two years will apply to existing drones. That is until December 31, 2022.
So there are three subcategories in the open category, which I am going to explain to you now.
Firstly, the Open subcategory A1. This allows you to fly above people.
Drone flights performed in subcategory A1 may only be
performed with drones that pose very little risk to people on the ground,
for example because they are very light or are constructed in such a way that the risk of
injury is minimal in the event of a crash. However, flying above crowds is never allowed.
In almost all cases, the drone pilot has to register. Only if your drone does not have a
camera and weighs less than 250 grams, this is not necessary. These are the so-called toy
drones. An example: the DJI Mavic Mini weighs 249 grams, so you do not have to take an exam,
but because it has a camera on board you do have to register as a pilot. And you have to register
with the RDW, the national road traffic service and there are also costs involved.
Registration with the RWD costs 23 euros per year.
You will receive a registration number and that number must also be affixed to the drone,
for example in the form of a fire plate , a sticker or a so-called dog tag. This number will
have to be broadcast by the new drones from 1 January 2023, so that enforcers can remotely
see who owns a particular drone. This is with the exception of the current drones
that do not yet have this functionality. With drones over 250 grams, you must
also complete an online theory course and exam in addition to registering with the RDW. Drones with a
CE label flying in this category may weigh a maximum of 900 grams (or 500 grams for
existing drones that do not yet have a CE label). The next subcategory is the Open subcategory
A2: This allows you to fly near people (and not above people).
The A2 subcategory is intended for drones with a maximum weight of 4 kg and which meet
a number of technical standards. (For current drones without a CE label,
this is a maximum of 2 kg). You must maintain a minimum distance of 30 meters horizontally in relation to
people on the ground (and when using current drones this is 50 meters). Future sold
drones that have a slow speed mode are allowed to approach people up to 5 meters.
In all cases, the operator (the drone pilot) must also register here again and in addition to the
compulsory online training + exam, you must also pass an additional exam. You must also
declare that you have gained some practical experience, but that will not be tested further.
You can draw up this statement yourself. And finally there is the Open subcategory A3:
flying far away from people. This category is intended for
heavier (for example self-build) drones up to 25 kg, model pilots and FPV racers.
You must maintain a horizontal distance of at least 150 meters from people and buildings. Important:
After 1 January 2023, all drones that do not have a C0 to C4 CE label will fall into this category (with the exception of
drones <250 grams, which will remain in A1). So also all drones that are still in use.
Registration of the pilot is again mandatory and an online exam is again mandatory.
In summary, it means that without registration and EU drone certificate you can only fly with a
drone that is lighter than 250 grams and without a camera. From 250 grams you always have to
register and successfully pass one or more exams, depending on the category the
drone is in. After you have passed the exam, you can apply for the European Drone Certificate at the RDW
. The costs are 10 euros and the certificate is valid for 5 years in all EU countries.
If you nevertheless go flying while you do not have an EU drone certificate and registration, you are
now punishable. You risk a fine and in case of damage or injury caused by your drone, it
is very questionable whether the liability insurance pays out. I compare it with driving
without a driver's license and without a license plate. I therefore strongly advise everyone to ensure
the correct documents and registration before taking off with a drone. You can prevent a lot of
trouble with it. I don't want to scare you, but please don't underestimate it.
I am already busy studying for the EU drone certificate to fly in the
categories A1, A2 and A3 and with that I can fly with my current drone,
the DJI Mavic 2 pro that weighs 907 grams, in all three categories . From 1 January
2023, I will unfortunately only be allowed to fly with this drone in the open subcategory three, and that
means at least 150 meters away from people, buildings, industrial and recreational areas.
Fortunately, we make a lot of nature images and people are not often seen in our images.
I am following my training at the Dutch Drone Academy and that is completely online,
including the exams. I will also take those exams through the Dutch Drone Academy.
When I am finished later I will have taken two exams, registered myself as a pilot
and applied for an EU Drone Certificate from the RDW and a statement from me stating
that I have practical experience. In addition to these categories, there are a number of rules
that always apply, so in all categories. Let me give a few examples: you are never allowed to fly higher
than 120 meters, only in daylight, not near airports, you are at least 16 years old,
you have third party insurance that covers damage caused by your drone, you always have the drone in
plain sight, and so on. What I think is an absolute improvement is that the drone rules now apply in all EU
countries and are therefore the same everywhere. Fortunately, you no longer have to ask yourself
in every country and look up what the applicable drone rules are. By the way, for me there is
one more important rule and that is: use your common sense. Also consider the privacy of people
and do not seek danger. Prepare your flight well and always look around you.
